Terms and Conditions of Service

1. Service provider identification
The ERP DLM service (hereinafter, "the Service") is provided by DATA LEAN MAKERS, S.L. (hereinafter, "DLM"), with tax ID (CIF) B93690386 and registered office at Calle Conrado del Campo 6, planta 1, puerta B, 29620 Torremolinos (Málaga), Spain. Contact email: info@dataleanmakers.es.
2. Purpose
These Terms and Conditions govern the access and use of the Service, an enterprise resource planning (ERP) system delivered as SaaS (Software as a Service) for freelancers and SMEs. By creating an account or accessing the Service, you accept these terms in full.
3. Registration and account
- Registration: the account is created through the site's registration form. You must provide truthful data and keep it up to date.
- Access responsibility: you are responsible for safeguarding your credentials and for all activity performed with your account. Notify us immediately of any unauthorised use.
- Lawful use: you agree not to use the Service for unlawful purposes or to introduce content that infringes third-party rights or applicable law.
4. Free trial and subscription plans
- Free trial: the Service offers a free 30-day trial, without a credit card, with access to the Business plan features. At the end of the trial you must subscribe to a paid plan to keep using the Service.
- Plans: the available plans (Starter, Business and Enterprise), their features and prices are described on the pricing page. Prices are expressed in euros, with applicable indirect taxes not included unless otherwise stated.
- Price changes: DLM may change prices with reasonable prior notice; the change will apply to the next billing period.
5. Billing and payment
- Frequency: the subscription is billed per period (monthly or annual, depending on the plan) and renews automatically unless cancelled in advance.
- Payment provider: payment is processed through Stripe. By subscribing to a paid plan you accept Stripe's terms for payment processing.
- Non-payment: if a payment cannot be processed, DLM may temporarily suspend access to the Service until payment is regularised.
- Plan changes: you may change plans at any time from the billing panel; the change is prorated automatically.
6. Suspension and cancellation
- Cancellation by the customer: you may cancel your subscription at any time from the billing panel. Cancellation takes effect at the end of the already-paid period.
- Suspension by DLM: DLM may suspend or cancel access in case of breach of these terms, fraudulent use or repeated non-payment, with prior notice except for justified urgency.
- Data after cancellation: upon cancellation, your data will be kept for the legally required period and, where applicable, deleted in accordance with the Privacy Policy and the Data Processing Agreement.
7. Liability and availability
- Availability: DLM will strive to maintain high availability of the Service, without guaranteeing a service level (SLA) unless expressly agreed in writing.
- Limitation of liability: to the extent permitted by law, DLM shall not be liable for indirect damages, loss of profits, data or business arising from the use or inability to use the Service.
- Customer content: you are solely responsible for the data and content you enter into the Service, its lawfulness, and having the legal bases to process it.
8. Intellectual property
The Service, its software, interface, documentation and brand are the property of DLM or its licensors. You are granted a limited, non-exclusive, non-transferable licence during the term of the subscription. The data and content you generate with the Service belong to you.
9. Processing of personal data
The processing of your personal data is governed by the Privacy Policy. With regard to the personal data of third parties (your customers, suppliers or employees) that you enter into the Service, DLM acts as data processor under the Data Processing Agreement (art. 28 GDPR).
10. Changes to the terms
DLM may modify these terms with reasonable prior notice. Continued use of the Service after the changes take effect constitutes acceptance.
11. Law and jurisdiction
These terms are governed by Spanish law. For any dispute arising from the Service, the parties submit to the courts and tribunals determined by applicable law, with preference for those of the consumer's domicile where applicable.
